Refund Policy

Please read this policy carefully before purchasing. By completing your purchase, you acknowledge that you have read and agreed to these terms.

Nature of the Product

Brand New Sleep sells a fully customized, made-to-order digital sleep plan. Each plan is individually created based on the information you provide in your intake form. Because this is a personalized digital product that requires significant time and expertise to prepare, our refund policy reflects the nature of the service.

No Refunds After Delivery

All sales are final once your sleep plan has been delivered. We do not offer refunds after delivery because the plan has been custom-created specifically for your child and cannot be returned or reused. We encourage you to review the product description thoroughly before purchasing.

Pre-Delivery Cancellation

If you wish to cancel before your plan has been created and delivered, please contact us as soon as possible at hello@brandnewsleep.com. We will make every reasonable effort to accommodate cancellation requests submitted prior to plan creation. Once work on your plan has begun, cancellation may not be possible.

Intake Accuracy

The quality and effectiveness of your sleep plan depends on the accuracy of the information provided in your intake form. We are not responsible for plans that are ineffective due to incomplete, inaccurate, or misleading intake responses. Please take care to answer all questions as honestly and thoroughly as possible.

Revision Requests

We want you to feel supported. If you believe your plan contains an error based on what you submitted in your intake form, please reach out within 7 days of delivery. We will review your concern and, at our sole discretion, make reasonable revisions to address the issue. Revision requests do not entitle you to a refund.

Medical Disclaimer

Brand New Sleep is not a medical provider. Our sleep plans are educational resources based on evidence-informed sleep coaching principles. They are not a substitute for advice from a licensed physician, pediatrician, or other qualified healthcare provider. We make no guarantee of specific results. Refunds will not be issued on the basis that a sleep plan did not produce a particular outcome.

Dispute Resolution and Arbitration

In the event of a dispute arising from your purchase, you agree to first contact us at hello@brandnewsleep.com and make a good-faith effort to resolve the issue directly. If we are unable to reach a resolution within 30 days, both parties agree to submit the dispute to binding arbitration in accordance with the rules of the American Arbitration Association (AAA). Arbitration shall take place in Morris County, New Jersey. You waive your right to participate in any class action lawsuit or class-wide arbitration.

Chargebacks

Filing a chargeback or payment dispute without first contacting us to attempt resolution is a violation of this agreement. If a chargeback is filed, we reserve the right to provide your intake form data, order information, and delivery confirmation to the relevant payment processor as evidence of fulfillment.

Governing Law

This Refund Policy is governed by the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes not resolved by arbitration shall be heard exclusively in the state or federal courts located in Morris County, New Jersey.
